AODA's Customer Service Standard applies to all Ontario retailers, regardless of employee count. It requires that goods and services be provided in an accessible way, which includes the digital channels customers use to research, browse, and contact your business. For retailers with 50 or more employees, the Information and Communications Standard also requires public-facing websites to conform to WCAG 2.0 Level AA. Private sector businesses with 20 or more employees must file an accessibility compliance report by December 31, 2026.
Retail and e-commerce sites account for the majority of digital accessibility lawsuits filed in the United States. Canadian retailers who sell to US customers are not automatically insulated from those claims. Does AODA apply to my retail business even if I have fewer than 50 employees?
Yes, in part. AODA's Customer Service Standard applies to all Ontario retailers regardless of size. The website-specific WCAG requirement under the Information and Communications Standard applies to public sector organizations and private businesses with 50 or more employees. Smaller retailers are not legally required to meet WCAG for their website, but they are expected to provide accessible service through their digital channels when requested.
